These Terms & Conditions apply to your use of soldacstudio.com and any pages, products, services, content, account features, GRAM pages, Vault features, and related online experiences offered by SOLDAC Studio through the website.

By using this website, creating an account, placing an order, opening a GRAM page, claiming a GRAM, or using any related feature, you agree to these Terms & Conditions.

If you do not agree, please do not use the website.

1. Who we are

This website is operated by SOLDAC Studio, based in Melgaço, Portugal.

SOLDAC creates and sells original artworks, limited Studio objects, GRAM collectibles, prints, apparel, and selected print-on-demand products.

Where required, consumers may also use the Portuguese Livro de Reclamações system. The Portuguese government describes the complaints book as a mandatory tool for many businesses providing goods or services to the public, allowing consumers to register complaints when something goes wrong.

2. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date.

Your continued use of the website after changes are posted means you accept the updated Terms.

3. Website use

You agree to use this website only for lawful purposes and in a way that does not harm, disrupt, overload, damage, or interfere with the website, our services, other users, or any connected systems.

You must not:

  • attempt to gain unauthorised access to any account, system, admin area, backend, database, server, or private feature;
  • interfere with the operation or security of the website;
  • use bots, scraping, automated extraction, or similar methods without our written permission;
  • upload or send viruses, malicious code, spam, or harmful content;
  • impersonate another person or business;
  • use the website for fraudulent, abusive, misleading, or unlawful purposes;
  • copy, reproduce, or exploit our content, product designs, artwork, branding, or system features without permission.

We may restrict, suspend, or terminate access if we believe these Terms have been violated or if we need to protect SOLDAC, our customers, our partners, or the website.

4. Accounts

Some features may require a customer account, including order history, GRAM claim, Vault access, owner features, eligible benefits, or support features.

You are responsible for keeping your login details secure and for activity under your account.

If you believe your account has been accessed without permission, contact us immediately at soldacstudio@gmail.com.

We may suspend or limit account access if we suspect misuse, fraud, unauthorised access, security risk, or violation of these Terms.

5. Products and availability

We may offer original artworks, limited Studio objects, GRAM collectibles, prints, apparel, accessories, and print-on-demand products.

Product availability, descriptions, prices, images, and specifications may change without notice. We try to display product information accurately, but minor differences may occur between product images and the item received, especially for handmade, limited, printed, or made-to-order items.

We reserve the right to:

  • limit quantities;
  • refuse or cancel orders where allowed by law;
  • correct errors in pricing, descriptions, or availability;
  • discontinue products or services;
  • reject orders that appear fraudulent, abusive, or technically incorrect.

If we cancel an order after payment, we will refund the amount paid where required.

6. Orders and payment

Orders are placed through the website checkout. By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the selected payment method.

Your order is not accepted until confirmed by us or by the checkout system.

Prices may include or exclude taxes, duties, shipping, or other charges depending on the checkout settings, destination, and applicable law.

You are responsible for any duties, customs charges, import taxes, or local fees that may apply to your order unless stated otherwise at checkout.

7. Shipping and delivery

Delivery times are estimates only. Delays may occur due to production, print-on-demand fulfilment, carrier delays, customs, local holidays, incorrect addresses, or events outside our control.

You are responsible for providing a correct shipping address.

If an item is returned to us because of an incorrect address, failed delivery, or refusal to accept delivery, additional shipping costs may apply.

8. GRAM collectibles

GRAM is SOLDAC’s flagship physical-digital collectible product. A GRAM may include a physical artwork or object, a live GRAM page, claim after delivery, Vault access, story updates, and eligible benefits when shown.

Unless stated otherwise on the product page, a GRAM purchase does not include:

  • guaranteed future benefits;
  • guaranteed external partner perks;
  • resale, trade, or marketplace access;
  • investment value;
  • transferability of all features;
  • copyright ownership of the artwork;
  • commercial rights to reproduce the artwork.

The first Studio GRAM drops focus on the connected physical artwork, live GRAM page, claim after delivery, Vault access, story updates, and eligible Studio benefits when included.

9. GRAM claim and Vault

Some GRAM features may require the buyer or owner to log in, open the live GRAM page, and claim the GRAM after delivery.

Claiming connects the GRAM to a customer account and may allow the GRAM to appear in the Vault.

You are responsible for using the correct account and keeping your login details secure.

We may limit, delay, reverse, or refuse claim, Vault, owner, benefit, or support actions if we suspect:

  • fraud;
  • unauthorised access;
  • incorrect order information;
  • lost, locked, replaced, revoked, or disputed item status;
  • technical error;
  • breach of these Terms;
  • abuse of the system.

We may also update, maintain, restrict, or change GRAM features over time.

10. Eligible benefits and future activations

Some GRAMs may include eligible Studio benefits, story updates, access features, or future activations when shown.

Benefits may vary by product, edition, owner status, location, time period, availability, and the specific rules shown for that benefit.

Unless clearly stated on a product page, benefits are not guaranteed, permanent, transferable, exchangeable for cash, or available in all locations.

Future Studio or partner activations may be added, changed, paused, or removed when necessary.

11. Intellectual property

All content on the website, including artworks, images, videos, text, designs, logos, graphics, product names, page layouts, software elements, and branding, belongs to SOLDAC Studio or its licensors unless stated otherwise.

You may view and use the website for personal, non-commercial purposes.

You may not copy, reproduce, modify, publish, distribute, sell, scrape, reverse engineer, imitate, or commercially exploit any part of the website, GRAM system, artworks, product designs, branding, images, videos, or content without our written permission.

Buying an artwork, product, print, GRAM, or digital access feature does not transfer copyright or commercial reproduction rights unless we expressly agree in writing.

12. User submissions and messages

If you send us messages, support requests, reviews, photos, comments, feedback, or other content, you confirm that you have the right to share that content and that it does not violate the rights of others.

You must not send unlawful, abusive, defamatory, misleading, harmful, infringing, spam, or malicious content.

We may use feedback or suggestions to improve SOLDAC, GRAM, products, or services without owing compensation, unless otherwise agreed in writing.

13. Third-party services

The website may use or link to third-party services, including Shopify, payment providers, shipping carriers, Printful, YouTube, Instagram, TikTok, analytics tools, maps, or other external services.

We are not responsible for third-party websites, platforms, content, policies, delays, outages, or decisions.

Your use of third-party services may be subject to their own terms and policies.

14. Print-on-demand products

Some products may be produced and fulfilled by Printful or another print-on-demand partner.

Print-on-demand products are usually made after the order is placed. Returns, exchanges, fulfilment times, and issue handling may depend on the fulfilment partner’s rules as well as applicable consumer law.

15. Returns, refunds, and consumer rights

Returns, refunds, damaged items, defective items, incorrect orders, sale items, original works, limited items, GRAM collectibles, and print-on-demand items are handled according to our Return & Refund Policy.

EU consumers may have a 14-day right of withdrawal for online or distance purchases, unless an exception applies. The European Union explains that for online goods, the cooling-off period is generally 14 days from delivery, and exceptions may apply for certain goods and services.

Nothing in these Terms limits any mandatory consumer rights that apply by law.

16. Website availability and changes

We try to keep the website and GRAM features available, but we do not guarantee uninterrupted, error-free, or permanent access.

We may update, modify, pause, restrict, or discontinue parts of the website, product pages, GRAM pages, Vault, claim features, benefits, or other services at any time where necessary.

We are not responsible for temporary unavailability caused by maintenance, third-party services, network issues, technical errors, security issues, or events outside our control.

17. Disclaimer

The website and related online features are provided on an “as available” basis.

To the fullest extent permitted by law, we do not guarantee that:

  • the website will always be available or error-free;
  • all content will always be accurate, complete, or current;
  • every GRAM feature, benefit, or activation will remain available permanently;
  • third-party services will operate without interruption;
  • the website will be free from technical issues or security risks.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable law.

18. Limitation of liability

To the fullest extent permitted by law, SOLDAC Studio will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or loss of opportunity arising from your use of the website or related features.

Our total liability for any claim related to an order will not exceed the amount paid for the relevant product, unless a different limit is required by law.

Nothing in these Terms limits liability where it would be unlawful to do so.

19. Indemnity

You agree to indemnify and hold SOLDAC Studio harmless from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, infringement of third-party rights, fraud, unlawful activity, or unauthorised access.

This does not limit any rights you have as a consumer under applicable law.

20. Governing law and disputes

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer protection rights that may apply in your country of residence.

If a dispute arises, please contact us first at soldacstudio@gmail.com so we can try to resolve it directly.

Where applicable, consumers may use the Portuguese Livro de Reclamações system or other legally available consumer dispute resolution mechanisms. The official Livro de Reclamações website allows consumers to make or consult complaints online.

The previous phrase “federal courts of Portugal” should not be used. Portugal does not have “federal courts” in the way that template suggests.
